The terms “we”, “us” and “our” refer to Rose Market. Rose Market operates this website and online store, including its information, content, features, products and services (collectively, the “Services”). Our online store is powered by Shopify.
These Terms of Service, together with the policies referenced in them, explain your rights and responsibilities when using our Services.
By accessing our website, creating an account or placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use our Services.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under the Australian Consumer Law.

We make reasonable efforts to ensure that product descriptions, images, prices and availability are accurate. However, product packaging, labels, colours, appearance or specifications may occasionally differ from the information displayed online.
Product images are for illustrative purposes. Colours may appear differently depending on your device and screen settings.
Availability is not guaranteed. We may update product descriptions, correct errors, limit quantities or discontinue products when reasonably necessary.

SECTION 3 — FOOD AND PERISHABLE PRODUCTS
Customers are responsible for reviewing product ingredients, allergen statements, preparation instructions, storage requirements and expiry or best-before information before consumption.
Information displayed on our website is general product information and is not medical or dietary advice.
If you have allergies, intolerances or specific dietary requirements, please review the product packaging carefully and contact us before purchase when additional information is required.
After delivery or collection, customers are responsible for storing perishable and frozen products appropriately.
SECTION 4 — ORDERS
Submitting an order constitutes an offer to purchase products from Rose Market.
An order is accepted when we confirm it and successfully process payment. We may decline or cancel an order where reasonably necessary, including because of:

* Incorrect pricing or product information
* Payment problems
* Suspected fraud or unauthorised activity
* Delivery limitations
* An error affecting the order
If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method where reasonably possible.
Please review your order carefully before submitting it. Once an order has been processed or dispatched, we may be unable to change or cancel it.
Returns, replacements and refunds are handled according to our Returns & Refunds Policy and the Australian Consumer Law.
SECTION 5 — PRICES, TAXES AND PAYMENT
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars and include GST where applicable.
Prices, promotions and availability may change without notice. The price charged will be the price displayed when you submit your order, except where there is an obvious pricing or technical error.
Online prices may differ from prices available in our physical store.
Shipping charges are calculated during checkout based on factors such as parcel weight, dimensions, destination and the selected delivery service.
You agree to provide accurate and authorised payment information. Orders may be delayed or cancelled if payment cannot be processed or verified.
SECTION 6 — SHIPPING AND DELIVERY
We currently deliver eligible online orders within Australia using Australia Post. Available Standard or Express Post services will be displayed at checkout depending on the delivery address and order.
Shipping charges are calculated at checkout according to the parcel’s weight, dimensions, destination and selected service.
Orders are generally processed within one to two business days. Delivery timeframes are estimates only and may be affected by Australia Post, public holidays, weather, destination, operational disruptions or circumstances beyond our reasonable control.
Customers are responsible for providing an accurate and complete delivery address. Additional costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.
If an order is lost, damaged or significantly delayed, please contact us so that we can investigate the matter with the carrier.
Nothing in this section excludes or limits rights or remedies available under the Australian Consumer Law.

SECTION 7 — CLICK & COLLECT
Where available, customers may select Click & Collect during checkout.
We will notify you when your order is ready. Please do not attend the store to collect an order before receiving confirmation.

SECTION 8 — RETURNS, REFUNDS AND CONSUMER RIGHTS
Returns, refunds and replacements are handled under our Returns & Refunds Policy and the Australian Consumer Law.
Change-of-mind returns may not be available for perishable food, opened food, used products or goods that cannot be resold for hygiene or safety reasons.
These limitations do not apply where a product is faulty, unsafe, incorrectly described, not fit for its disclosed purpose or otherwise fails to satisfy a consumer guarantee.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Consumer remedies depend on the nature and seriousness of the failure.
SECTION 9 — PROMOTIONS AND DISCOUNTS
Promotions, discount codes and special offers may be subject to separate conditions, including validity dates, product exclusions, minimum spending requirements and usage limits.
Unless expressly stated otherwise:
* Promotions cannot be combined.
* Discount codes have no cash value.
* Promotions may be changed or withdrawn before an order is accepted.
* Discounts cannot be applied retrospectively to completed orders.

Rose Market’s online store is powered by Shopify, which supplies the ecommerce platform used to provide the Services.
Purchases from our store are transactions directly between you and Rose Market. Shopify is not the seller of products purchased from Rose Market.
Nothing in this section excludes any liability that cannot lawfully be excluded.
